Legal Agreement for MOWCAST Services & Products

1. Services Offered

MOWCAST provides weather analysis tools and services designed for outdoor professionals and homeowners, including:

• Free Public Tool - Weather condition analysis on our homepage
• Professional Dashboard - Paid subscription service for managing multiple properties
• MOWCAST Smart Weather Display - Physical hardware device with weather monitoring capabilities
• Email Alerts & Notifications - Automated weather condition updates (for paid subscribers)

2. Weather Data Disclaimer

You acknowledge and agree:

• Weather forecasts are predictions, not guarantees. Conditions can change rapidly.
• MOWCAST aggregates data from multiple third-party weather services and data providers
• We are NOT responsible for inaccurate forecasts, failed predictions, or sudden weather changes
• You should always check local conditions and use your own judgment before working outdoors
• Never rely solely on MOWCAST for safety-critical decisions

3. INDEMNIFICATION - You Hold Us Harmless

You agree to indemnify, defend, and hold harmless MOWCAST, its owners, partners, employees, and affiliates from ANY claims, damages, losses, or expenses arising from:

Weather-Related Incidents

• Property damage caused by working in poor weather conditions
• Injury to yourself or others due to weather misjudgment
• Business losses from canceled jobs or schedule changes based on our forecasts
• Equipment damage from rain, wind, lightning, or other weather events
• Slip and fall accidents on wet grass or icy surfaces

Hardware Device (MOWCAST Smart Weather Display)

• Battery fires or explosions - including misuse, dropping, crushing, puncturing, or exposing the device to extreme heat
• Fire damage - if the device is thrown into fire, left in hot vehicles, or exposed to open flames
• Water damage - the device is NOT waterproof; liquid damage voids all warranties
• Electrical shock - from improper charging, using wrong power adapters, or tampering with internals
• Physical injury - from dropping, throwing, or otherwise misusing the device
• Property damage - caused by device malfunction, overheating, or user negligence
• Third-party injury - if your device harms someone else

Service Usage

• Your violation of these Terms of Service
• Your violation of any laws or regulations
• Unauthorized access to our systems or other users' accounts
• Your use of the service in a negligent or reckless manner

4. Hardware Device Safety & Warnings

DO NOT:

• ❌ Throw the device into fire or expose to extreme heat (>140°F / 60°C)
• ❌ Puncture, crush, or physically damage the device or battery
• ❌ Disassemble or attempt to repair the device yourself
• ❌ Use damaged or third-party chargers not approved by MOWCAST
• ❌ Leave charging unattended for extended periods
• ❌ Expose to water, moisture, or liquids (device is NOT waterproof)
• ❌ Store in extreme temperatures (below 32°F / 0°C or above 95°F / 35°C)
• ❌ Use near flammable materials or in explosive environments

Proper Use & Care:

• ✅ Use only on stable, dry surfaces (desk, table, shelf)
• ✅ Keep away from children and pets
• ✅ Charge using provided USB-C cable and approved power adapters only
• ✅ Unplug if device becomes hot, swells, or emits unusual odor
• ✅ Dispose of device properly according to local e-waste regulations
• ✅ Contact support immediately if device is damaged

If Battery Damage Occurs:

If the device is dropped, crushed, or shows signs of battery swelling:

• 🚨 Stop using immediately - disconnect power and do not charge
• 🚨 Move to safe location - place on non-flammable surface away from people
• 🚨 Do NOT dispose in regular trash - take to electronics recycling center
• 🚨 If smoke or fire occurs - evacuate area and call 911

5. Limited Warranty (Hardware Device)

MOWCAST Smart Weather Display comes with a 90-day limited warranty covering manufacturing defects only.

Warranty Covers:

• Display malfunctions not caused by physical damage
• Battery failures under normal use
• Software bugs preventing basic functionality

Warranty DOES NOT Cover:

• Physical damage (drops, cracks, water damage, fire, crushing)
• Normal wear and tear (scratches, fading, cosmetic wear)
• Damage from improper use, modification, or unauthorized repair
• Damage from power surges, lightning, or electrical issues
• Battery degradation after 90 days (normal battery aging)
• Lost or stolen devices

Warranty Remedy: Our sole obligation is to repair or replace defective devices at our discretion. No refunds after 30 days of purchase.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MOWCAST is provided "AS IS" without warranties of any kind, express or implied
• We do NOT guarantee uptime, accuracy, or continuous availability
• We are NOT liable for any damages including but not limited to:
  • Lost profits or business revenue
  • Property damage from weather events
  • Personal injury or death
  • Equipment or vehicle damage
  • Third-party claims
  • Data loss or service interruption
• If liability is found, our total liability is limited to the amount you paid (not to exceed $500 for device, $50/year for subscription)

7. Prohibited Uses

You may NOT use MOWCAST services or products for:

• Life-safety applications (aviation, marine navigation, emergency response)
• Critical infrastructure operations
• Medical or health-related decision making
• Any illegal activities or violation of regulations
• Reselling or redistributing our data without permission
• Reverse engineering or tampering with hardware/software

8. Account Terms (Paid Subscribers)

Payment & Billing:

• Subscriptions are billed monthly or annually as selected
• You authorize us to charge your payment method automatically
• No refunds for partial months or unused time
• Prices may change with 30 days notice

Cancellation:

• You may cancel anytime - access continues until end of billing period
• We may terminate accounts for Terms violations, non-payment, or fraudulent activity
• No refunds upon termination (unless required by law)

Free Trials:

• NO credit card required - Start your 14-day trial with just an email address
• NO automatic charges - Trial expires after 14 days; you choose whether to subscribe
• One trial per customer
• After trial ends, you can upgrade to a paid plan at any time

9. Intellectual Property

All content, design, software, and branding are owned by LXB Studio LLC and protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or distribute our software or content
• Use our trademarks or logos without written permission
• Scrape or automate data collection from our services

10. Third-Party Services

MOWCAST integrates with various third-party weather data providers, geocoding services, and AI analysis tools. We are not responsible for:

• Third-party service outages or data errors
• Changes to third-party APIs or data sources that affect our service
• Third-party privacy practices (see our Privacy Policy)

11. Changes to Terms

We may update these Terms at any time. Changes take effect immediately upon posting. Continued use constitutes acceptance of new terms. For paid subscribers, we'll email notification of significant changes.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Pennsylvania, USA. Any disputes must be resolved through binding arbitration in Lancaster County, Pennsylvania (except small claims court).

You waive your right to a jury trial or class action lawsuit.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
